Terms of Service

1. Acceptance of Terms

By accessing or using Controls.Support ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Building Vectors LLC, a Delaware limited liability company ("we," "us," or "Building Vectors").

2. Description of Service

Controls.Support provides AI-assisted diagnostic guidance for Building Automation Systems (BAS) and HVAC equipment. The Service is intended for use by qualified professionals including:

• Licensed HVAC technicians and engineers
• Building automation system programmers and technicians
• Facilities management professionals
• Controls engineers and system integrators

Access to the Service is by invitation only. We reserve the right to grant, deny, or revoke access at our sole discretion.

3. AI Diagnostic Disclaimer

You acknowledge and agree that:

• AI-generated diagnostic guidance may be incomplete, inaccurate, or inapplicable to your specific situation
• You are solely responsible for verifying any recommendations before acting on them
• Controls.Support is a decision-support tool, not a substitute for on-site inspection and professional judgment
• Working on HVAC and BAS equipment involves electrical, mechanical, and refrigerant hazards — always follow applicable safety standards, codes, and regulations
• You should never perform work outside your qualifications, licensing, or certifications based solely on AI guidance

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Share your account credentials or allow others to access the Service using your account
• Attempt to circumvent, disable, or interfere with the Service's security features
• Upload malicious files, code, or content intended to harm the Service or other users
• Use the Service to process information belonging to clients or employers without appropriate authorization
• Attempt to extract, scrape, or reverse engineer the underlying AI models or Service infrastructure
• Use the Service in any way that violates applicable federal, state, or local laws or regulations
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

5. Your Account

Access to the Service requires authentication via Google OAuth. You are responsible for:

• Maintaining the security of your Google account
• All activity that occurs under your account
• Notifying us immediately at support@controls.support if you suspect unauthorized access

We reserve the right to suspend or terminate your access at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion.

6. Uploaded Content

You may upload files, images, and configuration data to the Service for analysis. By uploading content, you represent and warrant that:

• You have the right to upload and share the content
• The content does not contain confidential information belonging to third parties unless you are authorized to share it
• The content does not violate any applicable law or the rights of any third party

You retain ownership of all content you upload. We use uploaded content solely to provide the diagnostic Service and delete it from temporary storage after processing.

7. Intellectual Property

The Service, including its design, software, AI models, and content (excluding your uploaded content and session history), is owned by Building Vectors LLC and protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your internal professional purposes. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our prior written consent.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• AI-generated diagnostic responses will be accurate, complete, or suitable for your specific situation
• Results obtained from the Service will meet your requirements

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CONTROLS.SUPPORT LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

This includes but is not limited to damages resulting from:

• Reliance on AI-generated diagnostic guidance
• Equipment damage, personal injury, or property damage resulting from work performed based on Service recommendations
• Service interruptions or data loss
• Unauthorized access to your account

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless Building Vectors LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Content you upload to the Service

11. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

12. Changes to Terms

We reserve the right to modify these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. Material changes will be communicated via the email address associated with your account. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

You may stop using the Service at any time. To request deletion of your account and data, contact us at privacy@controls.support.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
